AGREEMENT BETWEEN CUSTOMER/CLIENT/MEMBER AND MAJESTY TRAVELER

This agreement is entered into between the booking agent, Majesty Traveler., hereinafter referred to as MT, and you (the Client and/or the Member). Client and Member understands that by the very nature of our company, we are providing access to certain Itineraries, Packages, and Events (Events) which are unique and exclusive in nature. Therefore, the following terms are necessary and binding unless expressed otherwise in writing.This Web site is offered to you, the customer, the client and member, conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of this Web site constitutes your agreement to all such terms, conditions, and notices. Purchase of any Itinerary, Package, and Event constitutes agreement to the terms.

Deposits and Payment:
A 25% non-refundable deposit is due within 31 days of reservation to secure tickets/escort/passes/space/access/attendance.
The final non-refundable balance of the total price shall be paid in full 30 days prior to Event date.
For all Events, no tickets will be issued or access provided to client and member until MT receives full payment.
In the event full payment is not received by said date, any amounts already paid will be deemed non-refundable and earned by MT for all work performed, and the Event will be made available for sale to third parties.
All sales are final.

Events:
All advertised Events are subject to availability, and may change without notice to the client and member agrees that MT is not responsible for changes in Event dates and times, locations and accommodations. Client acknowledges that MT has no control over such changes. If said changes are made the client will not be entitled to a refund, unless at the discretion of MT. Ticketed events are sold for above face value, therefore, our purchase or sale price will not equal the price printed on the ticket.
All upgraded tickets are guaranteed to be equal or better than contracted for. Client and Member will be contacted to discuss any downgrade, to ensure that the tickets are suitable or if compensation is warranted.
MT reserves the right to substitute events of a pre-party or post-party nature for events of a similar nature.
MT shall not be held liable to the client for failure to provide insurance for package, itinerary, or events. All events include tickets, passes and or escort to events, once this access is purchased all tickets, passes and escort becomes immediately non-refundable after purchase. All deposits or partial payments for events goes to immediately secure tickets, passes and escorted access to events and therefore is considered NON REFUNDABLE. Customer cancellation the services ordered if such failure is due to actions and circumstances beyond the control of MT.

Prices and Seat Locations:
All orders will be assessed an 8% service charge, state sales tax (when applicable), and shipping fees (when applicable). Tickets are priced at the current market value and are subject to change at any time without notice.
We cannot specify exact seat location at all times, therefore, a general area in a designated category may be temporarily assigned. Seating charts serve as a guide when purchasing package that includes tickets and do not guarantee exact section and/or row locations.
In rare instances, a ticket price or event information may be listed incorrectly due to a typographical error by the supplier. If the supplier cannot honor the information listed then the order will be cancelled. And a refund will immediately be issued.

Cancellations and Refunds:
If an event completely cancels, then an in store credit will be issued. No cash refunds are given. If part of any event cancels, then no credits are issued.
MT is not liable for refunds under the following circumstances that are beyond our control: event postponement, rescheduling or time changes due to weather, nature, construction, or any other abnormal conditions or developments. MT is not responsible for misplaced, lost or stolen tickets. All packages including tickets, passes and or escort access to events is NON-REFUNDABLE in the event of cancellation. All tickets, passes and escort access to an event immediately NON-REFUNDABLE after purchase. All deposits or partial payments on packages, Tailor made itineraries, are NON-REFUNDABLE in the event or cancellation. All deposits or partial payments are non-refundable in the event of cancellation. Packages, Itinerary and Events that included tickets, passes, and escorted access are booked on a priority booking management table. This means the most sensitive portions of an Itinerary, Package, and event are booked first. Therefore all partial payments, and deposits that are collected will be immediately disbursed to secure ticket(s), pass(es) and escort and are considered to be NON REFUNDABLE.

Custom Requests:
If MT contracts with a client and member to arrange for a custom request not otherwise offered, client and member understands that MT may put forth significant time and effort while accumulating expenses in order to arrange this special request, which due to the custom nature of the request/experience, may not be marketable to other clients.
If client declines purchase after placing a custom request, client will be charged 25% of the contracted amount to compensate MT for time/expenses incurred up to that point.
If both MT and client and member agree that the undertaken experience did not meet the terms of the contracted request, then client must give MT at least two additional chances to fulfill request.
If client declines to re-schedule the special request, then they are not entitled to a refund.

Delivery:
Packages and Tickets and will be shipped as soon as they are physically available, but due to the demand on some events, certain tickets may not be delivered until the week of the event. In some cases tickets may be issued the day before or the day of the event.
On delivery orders, customers may be assessed a shipping fee ranging from $11 to $30 depending on the delivery method being utilized.

Disclaimer:
MT shall not be held liable to the client for failure to provide the services ordered if such failure is due to actions and circumstances beyond the control of MT.
Client understands that if they encounter any problems with any event or experience that is provided by MT, they have a responsibility to contact MT ASAP during the event while these problems are occurring. If a client does not contact MT and experiences the event/experience through completion, they are implicitly indicating that their satisfaction with the event/experience.
Client acknowledges that MT is a booking agent and has no responsibility and control over any of the aspects of the ticketed Event therefore cannot hold MT responsible for either negligence, strict liability, tort, product liability, intentional torts or under any other theory of liability for any death, loss of funds, thefts, damage to property, personal injury or any other loss suffered by the Client.
MT's liability under this Agreement shall not exceed in the aggregate the amount of monies paid to MT by Client.
MT is acting as an independent intermediary for suppliers of goods and services, which are not directly supplied by this company; such as air transportation, motor coach/shuttle/limo transportation, rental cars, hotel accommodations, meals, tours and event tickets. MT shall not be responsible for actions, errors, omissions or negligence on the part of such suppliers, which result in any loss, damage, delay, injury or death to you, your travel companions or group members. We shall not be responsible for any loss, damage, delay, injury or death to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, or any other action, omission, error, condition or negligence outside of our control. MT reserves the right to substitute hotels of equal status, alter itineraries, substitute airlines, change flight times and upgrade or downgrade event access/tickets. In the event of cancellation or postponement of a certain event, MT shall not be responsible for accommodations or transportation expenses incurred. We also reserve the right to cancel any reservations and remit a full refund to the cancelled party. Rates are subject to change without notice and tours, guest lists, escorted access and event tickets are subject to availability.

The client, by engaging MT, acknowledges these conditions and agrees to hold the company blameless in making the arrangements on his behalf, and agrees that restitution or damages, if any are claimed, shall be sought directly from individual suppliers for packaged event. The client also agrees to the terms and conditions of the tour and services, as set forth by the suppliers to MT. Payment of deposit and/or full payment shall constitute additional and further consent to all provisions set forth and stated herein.

Disputes:
Any controversy or claim arising out of or relating to travel services, packages, event package, errors and omissions, to this agreement in any manner whatsoever, or breach thereof, shall be resolved by BINDING ARBITRATION or DISPUTE RESOLUTION. Binding Arbitration will conducted by a single arbitrator in accordance with the Rules of the American Arbitration Association in the State of Georgia. Dispute Resolution will be conducted by payment processor PAY PAL. The location of such arbitration shall be the principal office of Majesty Traveler located in the state of Georgia. The decision of the arbitrator shall be final. Judgment upon any award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Purchase of any Packaged Event/Tailored Itinerary/Experience constitutes agreement of dispute resolutions and agree not to dispute or attempt to Charge back any of the acknowledged charges.
Purchase of any Packaged Event/Tailored Itinerary/Experience constitutes agreement to the above terms.

LIABILITY DISCLAIMER

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PUBLISHED ON THIS WEB SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN.

PROMOTIONS, UPGRADES, VOUCHERS or INCENTIVES
All promotions, upgrades, vouchers or incentives do not apply to rooms reserved through MAJESTY TRAVELER Reservation unless otherwise expressly stated on the Web site. All promotions, sale pricing, additional rebates or reduced rates, upgrades, vouchers are derived from majestytraveler.com unless otherwise stated. Fulfilling your request for a resort room match is included in the total amount indicated on the page from which you submit your request. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of Reservation that are made using your account. MAJESTY TRAVELER and its affiliates are not responsible for any submission you make.
